2. The nominee is Gideon Max Kline of 501 Blackburn Road, Mount Waverley VIC 3149.
3. Instructions on how to enter and other details contained within promotional advertisements for this prize draw (“the Draw”) form part of the Conditions of Entry and Terms and Conditions (“Terms’).
4. By entering the Draw, entrants (“the Customers”) agree to abide by these Terms.
5. Entry is open to customers who are eighteen (18) years of age or older and who complete an entry form in its entirety, that provides various details about the entrants and allows a representative of Metricon to contact the customer to discuss their home buying preferences. The entry form can be completed by completing an entry form that is distributed at the MBAV Building and Home Improvement Expo between 10:00am 16/05/08 through to 18/05/08 17:00pm. In addition, in order to be eligible to win the prize, the selected entrant must either enter into an unconditional building contract with Metricon to build a home with within 12 months from the date that the prize is drawn or must have already entered into an unconditional contract with Metricon to build a home after 16/5/08. Only entries on the prescribed form will be eligible for any prize
6. The promotion commences at 9:00am on the 16th day of May 2008 and closes at 5:00pm on the 30th September 2008.
7. The last date and time for entry into the first draw is 5:00pm on 18 May 2008.
8. The first prize will be randomly drawn from a barrel on the 30th day of May 2008 at 2:00pm at Metricon’s office, 501 Blackburn Road, Mount Waverley VIC 3149. The winner will be drawn from all correctly registered entries.
9. The last date and time for entry into the second draw is 5:00pm on 17 August 2008.
10. Any entrants into the first draw who do not win the first prize, will not be entered into the second draw and will not be eligible to win the second prize.
11. The second prize will be randomly drawn from a barrel on the 15th day of October 2008 at 2:00pm at Metricon’s office, 501 Blackburn Road, Mount Waverley VIC 3149. The winner will be drawn from all correctly registered entries.
12. The first and second prize are each a $10,000 deposit towards the purchase of a home from Metricon’s range of homes.
13. The first and second prize must be redeemed within 12 months from the date that the prize is drawn, as noted in clauses 8 and 11 of these Terms, or the respective prizes will be forfeited and Metricon will not be liable in any manner whatsoever for any prize that is not redeemed within that 12 month period.
14. If the Metricon home is constructed or is to be constructed on land in Victoria, Metricon Homes Pty Ltd will provide the prize.
15. If the winner of the first prize is, at the date of the first prize draw, building a Metricon home or has completed the building of a Metricon home within 12 months from such date, the relevant Applicant will credit or pay (as the case may be) the winner the sum of $10,000.
16. If the winner of the second prize is, at the date of the second prize draw, building a Metricon home or has completed the building of a Metricon home within 12 months from such date, the relevant Applicant will credit or pay (as the case may be) the winner the sum of $10,000.
17. Other than pursuant to clauses 15 and 16 above, the prize cannot be redeemed for cash.
18. The winner of the first prize will be notified by telephone and in writing by 2nd June 2008.
19. The winner of the second prize will be notified by telephone and in writing by 17 October 2008.
20. It is the responsibility of the winner to collect their respective prize.
21. Metricon accepts no responsibility for any accident, loss, injury or damage to any individual or property arising out of or in connection with either Draw or the prizes, either during or after the Draws.
22. The Customer/s must agree to make themselves available for publicity purposes at any time without charge. Any customer (including but not limited to any winning entrant) that does not comply with these Terms will be ineligible to win any prize and even if the entry of such entrant is drawn so that such entrant would otherwise have been a winner, then such entrant will forfeit any prize that the entrant may otherwise be entitled to. Merion’s decision on whether there has been compliance with thee Terms will be final and no correspondence will be entered into.
23. Entry into either Draw signifies acceptance of all Terms.
24. Metricon’s decision will be final and no correspondence will be entered into.
25. Metricon reserves the right to limit entry or amend rules if considered necessary without notice.
26. Staff of Metricon and their immediate families are ineligible to enter either Draw. Immediate family shall be deemed to include mother, father, son, daughter, brother, sister, husband, wife or de facto husband or wife.
27. Metricon is not responsible for any tax implications that may arise from the prize winnings. Independent financial advice should be sought if required.

29. Metricon is collecting your name, postal address, email address and mobile phone number, or daytime phone number, in order to include you in this Draw and so that they may contact winners.
